Principles of personal data processing

The administrator of your personal data is DataServe S.A.

To ensure the security of your data, the administrator has appointed a person responsible for the protection of personal data, who can be contacted at iodo@dataserve.eu

Your data provided to us on a voluntary basis as part of our business contacts will be processed in DataServe only to enable subsequent communication with you in response to inquiries sent to us or to execute active orders.

The scope of processed data is limited to those indicated in the contact form on our website or to those placed on your business cards provided to us.

1. Identity of the administrator

The administrator of the data is DataServe, located in Warsaw (02-495) at Wladyslaw Jagielly 4/U3, responsible for maintaining the www.biinsight.pl website and communicating with visitors to the site.

By letter - sending correspondence to the above-mentioned address of the DATASERVE headquarters with the note "Data Protection Representative."

 

You can contact the designated person in all matters relating to the processing of personal data and the exercise of rights related to data processing.
 

3. Data acquisition

If you are a representative person, the personal data were obtained directly from you, as a representative of the Contractor, within the framework of the contract, annex or other registered documents connecting him with ADO (hereinafter: "Contract"). 

If you are the contact person indicated in the Agreement or the person performing activities under the Agreement, the personal data was obtained directly from you or from the Contractor in the course of performing cooperation with ADO.

Personal data acquired may include:
- name,

- business phone number(s),

- business electronic mail (e-mail) address,

- position or function in the contractor's organizational structure.
 

4. Processing purposes and legal basis

Your data will be processed for:

  1. Fulfillment of legal obligations incumbent on ADO related to, among other things:
    - tax regulations and accounting regulations,
    - Fulfillment of law enforcement requests and for the purposes of legal proceedings, in the event of a request for access to data by the relevant authorities, the legal basis for data processing is Article 6(1)(c) RODO. 

  2. Performing business and legal activities related to the process of concluding an Agreement or offering products and services - the legal basis for processing personal data is the ADO's legitimate interest (Article 6(1)(f) RODO); 

  3. To carry out business and legal activities related to the concluded Agreement - the legal basis for processing personal data is ADO's legitimate interest (Article 6(1)(f) RODO);

  4. Establishing and asserting potential claims or defending against such claims by ADO - the legal basis for processing personal data is ADO's legitimate interest (Article 6(1)(f) RODO); 

  5. Archiving (evidence), which will be the realization of ADO's legitimate interest in securing information in the event of a legal need to prove facts - the legal basis for data processing is ADO's legitimate interest (Article 6(1)(f) RODO);

5. Recipients of data

Your personal data may be transferred to entities providing services to ADO that require access to data, in particular, to entities providing legal, consulting, auditing, accounting, financial, IT, archiving and document destruction services, as well as to entities to which ADO is authorized or obliged to transfer them by law (e.g. to public authorities, courts, prosecutor's office or the police). Your personal data may also be transferred to postal operators (in connection with sending correspondence), providers of IT systems and IT services.


6. Your rights with respect to your personal data

You have the right: to access your own data, to rectify, transfer, delete them, as well as to request the restriction of their processing, and the right to object on grounds related to your particular situation, in case ADO processes the data based on its legitimate interest. This is possible after sending a request to iodo@biinsight.pl with a proper description of the data to which the request relates. The request must be expressed in a form that makes it possible to unambiguously identify the requester and link it to the data to which the request relates.

7. Data retention period

The period of storage of your data depends on the purpose for which the data is or may be processed. Personal data will be processed for the term of the Agreement and after its termination for:

- The period necessary for the performance of obligations or rights under the law;

- The period of the statute of limitations for claims and until the completion of civil, enforcement, administrative and criminal proceedings requiring data processing.


8. Automated data processing

Your personal data will not be subject to processes involving automated decision-making, including profiling.


9. The right to lodge a complaint with the supervisory authority

You have the right to lodge a complaint with a supervisory authority as part of a violation of the provisions of RODO. In the Republic of Poland, the supervisory authority is:

10. Information about the voluntariness or obligation to provide data

Provision of data is voluntary, however, failure to provide your data will result in the inability to carry out business contacts under the Agreement with your participation.
